This policy governs the use of the You-Day website (the "Website”). The website is designed to allow users to make event purchases, register for events, and communicate with YouDay team.
Acceptance of terms of use
By accessing, browsing, and/or using the website and/or any facility operated by YouDay, classes and events, you accept and agree to be bound to these terms.
Events
The current schedule is mentioned on the Website. YouDay reserves the right to change the schedule at any time. If possible, any changes are announced in advance by mentioning them on the website or by email. YouDay reserves the right to cancel a class that has been scheduled or to change the trainers mentioned in the schedule. In case of a cancellation, the credit will be refunded. YouDay reserves the right to change the prices.
Liability
Attending YouDay events and leaving belongings in the venue are at your own risk. YouDay accepts no liability whatsoever for physical injury, loss or damage relating to attending events and leaving belongings in the venue.
By signing up for and/or attending events, activities, and other programs and using various venues, facilities and equipment, you here by acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in the workouts and exercise equipment in association with the classes.
At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by the YouDay staff.
YouDay provides the following guidelines for reducing the risk of an injury:
Consult a doctor before starting YouDay classes and events, especially if you are not feeling well or if you are pregnant. If you have an injury or any other physical inconvenience, always inform your trainer about this prior to exercise.
In consideration of being allowed to participate in and access the event, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the event and facilities, (2) release, indemnify, and hold harmless YouDay, direct and indirect parent, subsidiary affiliate entities, the venues, the trainers and each of their respective directors, members, employees, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the classes and events or use of the facilities, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using any of YouDay classes, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in using the classes you should not be participating in any classes.
Privacy notice
We collect most of this personal information directly from you when you register with YouDay, buy a ticket to an event, use our website, interact with us.
Your booking for an event is a contract between you and YouDay, so we require your personal data, to allow you to access the event and for us to verify your identity when necessary, along with taking payment for the service we are providing.
We will store information regarding the classes you are attending and specific requirement in order to ensure we have sufficient equipment available and that we are adhering to health and safety and insurance requirements.
We may need to contact you by email, phone, letter and/or SMS for administrative, customer service or operational reasons, please be aware that these communications are not made for marketing purposes and as such, you will continue to receive them even if you choose not to receive marketing communications.
We will also use your personal data to contact you if you have filled in a web-form through our website, emailed or called us, or contacted us on social media.
Your opinion is very important to us, so we may send you an email or SMS to seek your feedback. We will use the communications you exchange with us and the feedback you may provide in order to manage our relationship with you as our customer and to improve our services and experiences for other users.
We may also collect information on how you use our website, which pages of our website you visit most, in order to understand what you like. We may use this information to tailor the content and offers that you see on our website and to send you relevant messages that we think you might like.
When you participate to a YouDay event or class, you might be visible on pictures and/or video content produced by and for YouDay. YouDay typically uses such content on the web site, in social media, or in commercial documents. If you wish not to appear in such content, you should specifically inform YouDay by email prior to the event you participate in.
Acceptance
By using the website, you signify your acceptance of the Terms and Conditions.
If you do not agree to this, please refrain from using the website and events. Your continued use of the website following the posting of changes to these terms will indicate your acceptance of those changes.
Retreat Cancellation/Adjustment Policy
1. Cancellation by Participant:
- If a participant cancels more than 30 days prior to the start date of the event, a 50% refund of the fee will be issued. If a participant cancels less than 30 days prior to the start date of the event, no refund will be issued.
2. Cancellation by Organizer:
- In the unlikely event that the event is cancelled by the organizer due to unforeseen circumstances or insufficient enrolment, a full refund of the event ticket fee will be issued.
3. No-Show:
- If a participant fails to attend the event without providing prior notice, no refund will be issued.
4. Changes or Transfers:
Participants may request to transfer their registration to another person up to 7 days prior to the start date of the event, subject to approval by the organizer.
